Terms of Service

By creating an account or otherwise using Ascendya Finance ("Ascendya," "we," "us," or "our"), you agree to these Terms of Service and to our Privacy Policy, which is incorporated into these terms by reference. If you do not agree, do not use the service.

During account creation you are asked to affirmatively confirm that you accept these terms. That confirmation is required before an account can be created. Continuing to use Ascendya after these terms change also constitutes acceptance of the updated version.

These terms form a binding agreement between you and the operator of Ascendya. Where these terms refer to obligations of Ascendya, they refer to that operator.

Ascendya is an educational personal-finance workspace. You enter information about your own money — income, bills, expenses, subscriptions, savings targets, and goals — and Ascendya organizes it, performs arithmetic on it, and presents it back to you as budgets, forecasts, scenarios, and summaries.

What Ascendya does not do

• Ascendya does not connect to your bank, credit union, credit card, brokerage, or any other financial account. There is no account-aggregation integration in the product.
• Ascendya never moves, holds, transfers, invests, or has custody of money. It cannot make a payment on your behalf.
• Ascendya does not read your transactions. Every figure in the product is one you typed in yourself, or one calculated from figures you typed in.
• Ascendya does not check, report, or affect your credit.
• Ascendya is not a bank, credit union, money transmitter, broker-dealer, investment adviser, financial planner, insurance producer, tax preparer, accountant, credit-repair organization, debt-settlement provider, or law firm, and it is not acting as any of these.

Because everything Ascendya shows you is derived from what you entered, its output is only as accurate as your input. An out-of-date bill amount or a mistyped paycheck will produce confident-looking numbers that are wrong.

Ascendya is presently offered at no cost. There is no subscription, no paid tier available for purchase, no trial that converts to a charge, and no payment processor integrated into the product. We do not collect card numbers, bank details, or any other payment credentials, and no part of the service asks you for them.

You should treat any communication that asks you to pay for Ascendya, or that requests payment details on our behalf, as fraudulent, and you can report it to us at the address in the final section.

We may introduce paid features in the future. If we do, we will publish updated terms covering pricing, billing, renewal, cancellation, and refunds before any charge could be made, and we will not convert an existing free account into a paying one without your express, separate consent.

Because Ascendya is free, we do not guarantee any particular level of service, availability, support responsiveness, or continuity, and we may modify or discontinue the service as described below.

You must be at least 18 years old to create an account or use Ascendya. Ascendya is intended for adults managing their own household finances, and we do not offer accounts to minors.

By using Ascendya you represent that you meet these requirements, that the information you provide during registration is accurate, and that you are not barred from using the service under applicable law.

Ascendya is not directed to anyone under 18, and we do not knowingly permit minors to create accounts. During sign-up you are asked to confirm that you meet this requirement. If we learn that an account belongs to someone under 18, we may suspend or remove it. See the corresponding section of our Privacy Policy for how we handle information we learn belongs to a minor.

Accounts are created and authenticated through Clerk, our third-party identity provider. Your password (or your chosen sign-in method) is handled by Clerk; Ascendya never receives or stores your password.

You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. You agree to notify us promptly at the contact address below if you believe your account has been accessed without your authorization.

You may not share your account, sell it, transfer it, or permit anyone else to use it. You may not create an account using another person's identity or using automated means.

We are not liable for losses arising from unauthorized use of your account where that use resulted from your failure to safeguard your credentials.

Ascendya's usefulness depends entirely on the accuracy and completeness of what you enter. You are solely responsible for the financial information you provide, and for keeping it current.

Ascendya does not verify your entries against any external source. It cannot detect that a bill amount has changed, that a paycheck was different from what you logged, or that an expense was omitted. Calculations, forecasts, "safe to spend" figures, and affordability indications will be wrong in proportion to any error in your inputs, and they may be wrong in ways that are not obvious.

You should independently verify any figure before relying on it for a decision that matters.

Everything Ascendya provides is general educational information and computational assistance. It is not advice, it is not personalized to your circumstances in any professional sense, and it must not be treated as a substitute for a qualified professional who knows your situation.

Specifically

• No financial or investment advice. Ascendya is not a registered investment adviser and does not provide investment recommendations, securities analysis, or advice about buying, selling, or holding any asset.
• No tax advice. Nothing in Ascendya is tax advice, and no output should be used to prepare or support a tax filing. Consult a qualified tax professional.
• No legal advice. Ascendya may surface information about legal-aid organizations, but it does not provide legal advice and using it does not create an attorney-client relationship with anyone.
• No accounting advice. Ascendya is not a bookkeeping system of record and its figures are not audited or reconciled.
• No insurance, credit, or debt-settlement advice. Ascendya does not evaluate insurance products, negotiate with creditors, or provide credit repair or debt-settlement services.
• No medical or crisis services. Where Ascendya surfaces health-related or crisis resources, it is directing you to third parties, not providing care.

Financial decisions are yours alone. You are solely responsible for any action you take or do not take based on anything you see in Ascendya, and you agree that we are not responsible for the outcome of those decisions.

Features including the Life Planner, the confidence forecast, the what-if simulator, and any chart or figure describing a future period produce illustrative projections based on assumptions — assumptions you select, assumptions implied by your inputs, and simplifying assumptions built into the calculations.

These projections are arithmetic exercises, not predictions. They do not account for inflation, taxes, investment returns, interest, job loss, illness, changes in household composition, market conditions, or any other real-world variable unless you have explicitly modeled it yourself. Actual outcomes will differ, often substantially.

No projection in Ascendya is a guarantee, promise, or reasonable expectation of any financial outcome.

Afford It is a beta feature. You describe a problem, provide an approximate budget and a ZIP code, and Ascendya suggests categories of help — including assistance programs, nonprofits, government programs, community organizations, and paid providers.

How results are produced

Your description is categorized on your own device using fixed keyword and pattern rules. It is not sent to an artificial-intelligence provider, and it is not transmitted to us for this purpose. Results are drawn from a curated list of national organizations maintained in the application, ordered by a scoring formula that weighs relevance, cost, accessibility, distance, and reliability.

What Afford It does not verify

• We do not verify that a listed organization currently operates in your area, has funding available, is accepting applications, or offers the specific service you need.
• We do not determine your eligibility for any program. Language such as "you may qualify" means exactly that — only the organization itself can decide.
• We do not set, quote, negotiate, or guarantee any price. Cost indications are estimates or ranges, never quotes.
• We do not endorse, vet, license-check, insure, background-check, or recommend any third-party business or organization, and a listing is not a recommendation.
• Where Afford It links to a general provider search rather than a specific business, the results of that search come from the search provider, not from us.

Your dealings with any third-party organization or business are solely between you and them, including the quality of services, pricing, scheduling, disputes, damages, and any contract you enter. We are not a party to those dealings and are not liable for them. Confirm important details — cost, eligibility, licensing, insurance, timing — directly with the organization before relying on them or paying anyone.

Beta features may be incomplete, may produce inaccurate or unhelpful results, and may be changed or withdrawn at any time without notice.

Ascendya is not an emergency service and must never be relied on in an emergency. It cannot summon help, cannot contact anyone on your behalf, and may be unavailable at any time.

If anyone is in immediate danger, call 911 (or your local emergency number). For a mental-health or suicidal crisis in the United States, call or text 988.

Afford It attempts to recognize descriptions that suggest immediate danger and to show a safety message instead of search results. This detection is a simple pattern check, is not reliable, and will both miss real emergencies and flag situations that are not emergencies. Do not depend on it.

Ascendya does not currently offer a live artificial-intelligence assistant. The Ascendya Chat workspace displays a "Coming Soon" notice and does not accept or process messages. No feature in the product sends your information to an external AI provider.

Afford It's categorization runs locally on your device using fixed rules. Although it interprets what you write, it is not a generative model, it does not learn from your input, and nothing you type is transmitted for that purpose.

If we introduce an AI feature in the future, we will update these terms and our Privacy Policy beforehand to describe what is sent, to whom, how it is retained, and what the limitations are. AI output, when it exists, will be non-deterministic, may be inaccurate or fabricated, and will be subject to all of the disclaimers in these terms.

You agree to use Ascendya only for lawful, personal, non-commercial purposes, and you agree not to:

• Use the service to break any law or regulation, or to facilitate anyone else in doing so.
• Enter another person's financial or personal information without their knowledge and permission.
• Attempt to access another user's account, data, or synced records, or any part of our systems you are not authorized to reach.
• Probe, scan, or test the vulnerability of the service, or breach or circumvent authentication, authorization, or rate-limiting measures.
• Reverse engineer, decompile, or disassemble the service, except where that restriction is prohibited by law.
• Scrape, crawl, harvest, or bulk-extract content, or use bots or automated means to access the service.
• Copy, resell, sublicense, or redistribute the service or its content, or present it as your own product.
• Upload malware, or interfere with, overload, or disrupt the service or its infrastructure.
• Impersonate any person or organization, including Ascendya or its staff.
• Remove, obscure, or alter any proprietary notice, disclaimer, or attribution.
• Use the service to harass, defraud, or harm anyone.

We may investigate suspected violations and may suspend or terminate access as described below.

The financial information, notes, goals, scenarios, and descriptions you enter remain yours. We claim no ownership of them.

You grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, transmit, and display that content strictly for the purpose of operating the service for you — for example, saving your data so it is there when you return, and synchronizing it between your devices if you use that feature. This license exists only to run the product for you; it does not permit us to publish your content, sell it, or use it for advertising. It ends when you delete the content or your account, subject to the retention described in our Privacy Policy.

You are responsible for maintaining your own copies of anything you would not want to lose. Ascendya provides a data export feature, and we encourage you to use it. We do not guarantee against data loss.

If you send us feedback, bug reports, feature requests, or suggestions — including through the in-product feedback controls — you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use them for any purpose without obligation, attribution, or compensation to you.

Please do not include confidential information or the personal information of others in feedback.

Ascendya, including its software, design, interface, text, graphics, logos, name, and the selection and arrangement of its content, is owned by us or our licensors and is protected by intellectual-property law.

Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Ascendya for your own personal financial organization. All rights not expressly granted are reserved. Nothing in these terms transfers ownership of anything to you.

Third-party names, marks, and materials referenced in Ascendya — including the names of assistance programs and organizations — belong to their respective owners and are used for identification only. Their appearance does not imply affiliation with, sponsorship by, or endorsement from them.

If you believe material in Ascendya infringes your copyright, contact us at the address in the final section with enough detail to identify the work and the material at issue.

We provide Ascendya on an as-available basis. We do not promise that it will be uninterrupted, timely, error-free, or available at any particular time, and we may take it down for maintenance, updates, or any other reason.

Ascendya depends on third-party infrastructure — including our hosting provider, our identity provider, and, where you use synchronization, our database provider. An outage, degradation, change, or termination affecting any of them may make Ascendya wholly or partly unavailable, and those events are outside our control.

We may add, change, suspend, or remove features at any time, including features you rely on. Features labeled beta or experimental are provided for evaluation, may behave unpredictably, and may be withdrawn without notice.

You may stop using Ascendya at any time. You can clear the data stored on your device from within the application, remove any synchronized server copy, and delete your account through your account settings.

We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these terms, if your use poses a security or legal risk to us or to others, or if we are required to do so by law. Where it is practical and lawful to do so, we will tell you why.

We may also discontinue Ascendya entirely. If we do, we will make reasonable efforts to give advance notice so you can export your data.

Effect of termination

On termination your license to use the service ends immediately. Data stored locally on your device remains on that device until you or your browser removes it. Server-side data is handled as described in our Privacy Policy. Sections of these terms that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive termination.

To the fullest extent permitted by law, Ascendya is provided "as is" and "as available," without warranty of any kind, whether express, implied, or statutory.

We specifically disclaim the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade.

Without limiting the foregoing, we do not warrant that: the service will meet your requirements; it will be available, uninterrupted, secure, or error-free; any calculation, projection, figure, or recommendation is accurate, complete, current, or suitable for your circumstances; any third-party organization, program, business, price, or eligibility indication is accurate or available; or that defects will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. In that case, our warranties are limited to the minimum extent permitted by law.

To the fullest extent permitted by law, neither we nor our founders, contributors, or suppliers will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, savings, data, goodwill, or opportunity, arising out of or relating to your use of or inability to use Ascendya — even if we have been advised that such damages are possible.

This includes, without limitation, any loss arising from: a financial decision you made using Ascendya; an inaccurate calculation, projection, or affordability indication; information you entered incorrectly or failed to update; your dealings with any third-party organization or business surfaced by Afford It; a program you did not qualify for; unavailability or downtime; loss or corruption of data; or unauthorized access to your account.

Because Ascendya is provided free of charge, our total aggregate liability for all claims relating to the service is limited to one hundred U.S. dollars ($100).

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by negligence.

You agree to indemnify, defend, and hold harmless Ascendya and its founders and contributors from any claim, demand, loss, liability, damage, cost, or expense (including reasonable legal fees) arising out of or relating to: your use or misuse of the service; your violation of these terms or of any law; your infringement of anyone's rights; information you entered about another person without their permission; or your dealings with any third party surfaced through the service.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

These terms and any dispute arising out of them or out of your use of Ascendya are governed by the laws of the State of [GOVERNING STATE], without regard to its conflict-of-laws rules.

Before filing any formal claim, you agree to contact us at the address in the final section and to attempt in good faith to resolve the dispute informally for at least thirty (30) days. Most issues can be resolved this way.

If informal resolution fails, you and we agree that any dispute will be brought exclusively in the state or federal courts located in [GOVERNING VENUE], and both of us consent to personal jurisdiction there.

To the fullest extent permitted by law, you and we agree that any dispute will be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Any claim relating to Ascendya must be filed within one (1) year after it arose, or it is permanently barred, unless applicable law requires a longer period.

The bracketed items above must be set to a real state and venue before these terms are relied on. They are marked rather than guessed because the choice depends on where Ascendya is legally established.

Entire agreement

These terms, together with the Privacy Policy, are the entire agreement between you and us regarding Ascendya, and supersede any prior understanding on that subject.

Severability

If any provision is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if that is not possible, and the remaining provisions will stay in full force.

No waiver

Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment

You may not assign or transfer these terms or your account without our written consent. We may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets, subject to the corresponding section of the Privacy Policy.

Force majeure

We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failure, or the failure of a third-party provider.

Relationship

These terms do not create any partnership, joint venture, employment, agency, or fiduciary relationship between you and us. We owe you no fiduciary duty.

Notices

We may give you notice by email, by posting in the application, or by publishing on this page. You may give us notice at the address in the final section.

We want Ascendya to be usable by as many people as possible, including people who use screen readers, keyboard navigation, magnification, or other assistive technology. Our Accessibility Statement describes our approach, the standards we work toward, the limitations we currently know about, and how to report a barrier.

If any part of Ascendya prevents you from using it because of a disability, tell us at the contact address below and describe what you encountered and what assistive technology you use. We treat accessibility reports as bugs and will work with you on an alternative way to accomplish the task in the meantime.

The Accessibility Statement is a description of our practices and commitments. It is not a warranty of conformance with any particular standard, and it does not expand the warranties or liability set out in these terms.

We may update these terms as Ascendya changes. When we do, we will revise the effective date at the top of this page.

If a change materially reduces your rights or materially increases your obligations — for example, introducing charges, or changing how disputes are resolved — we will make reasonable efforts to notify you directly, such as by email or an in-product notice, before it takes effect.

Your continued use of Ascendya after an update takes effect constitutes acceptance of the revised terms. If you do not agree, stop using the service and delete your account.

We read every message and respond as quickly as we reasonably can. Ascendya is operated by a small team, so please allow a reasonable period for a reply. Do not use this address for emergencies.

The legal entity operating Ascendya, and its business address, are not yet established and are therefore not stated here. They must be added before these terms are relied on in any dispute.
